Novabelvarispx is the commercial trading name of Novabelvarispx GmbH, Werner-von-Siemens-Straße 6, 86159 Augsburg, Deutschland. The identity of the seller along with registration details can be found in the legal notice and the order confirmation. Returns of devices or accessories require the prior assignment of an authorized return address; shipments sent to other addresses will not be accepted.

Placing orders requires a minimum age of 18 years. All products are intended for private, non-commercial personal use unless agreed otherwise in writing. We reserve the right to refuse, limit, or cancel orders in cases of insufficient verifiability, lack of stock, or suspected abuse. Any amounts already collected will be refunded promptly.

All amounts are quoted in EUR. Shipping costs are explicitly stated in the checkout area before the contract is concluded. In the event of an obvious calculation or pricing error, we reserve the right to make a correction prior to dispatch, with you remaining free to confirm at the corrected price or cancel free of charge.

3.1 VAT and customs duties

Amounts for shipments within Germany include statutory sales tax where applicable. For delivery addresses outside Germany, customs duties, import taxes, and official fees are determined by the destination country; these costs are borne by the recipient. If refusal of customs clearance results in a return shipment, the incurred transport costs will be deducted from the refund amount.

We accept Cash on delivery, Bank transfer. No card or online banking details are collected on this website.

4.1 Order placement and acceptance

Submitting the order form constitutes a binding offer to purchase. Upon receipt, you will receive an automated message with an order number; the purchase contract only takes effect once the goods are handed over to the carrier and the dispatch confirmation is sent. Until this step, we reserve the right to decline the order with a full refund of any payments already made.

4.2 Failed or incomplete payments

Orders with failed or incomplete payments will not be shipped. If cash on delivery is selected, an uncollected or refused parcel will result in return to our warehouse and cancellation of the order.

Personal data is collected and used solely for order processing, handling inquiries, and maintaining system operations in accordance with the Privacy Policy. Details on cookies and identifiers can be found in the Cookie Policy. Both provisions form an integral part of these Terms and Conditions.

Use hearing technology and care products as described on the product page, on the label, and in the enclosed instructions. Keep items out of the reach of children unless they are expressly intended for them. Product photos show the items shipped; screen colors depend on your display settings, and minor color variations do not constitute a defect.

6.1 Storage, expiry and disposal

Store the product in accordance with the information on the packaging. If a best-before or expiration date is indicated, do not use the product after that date. Dispose of packaging and discarded items in accordance with local regulations.

Displayed discounts apply only to orders placed within the promotional period and cannot be combined unless specified otherwise. Promotional codes must be redeemed at checkout before completing the payment process; retroactive deductions after the order has been placed are excluded. In the event of a return, any free promotional items must be returned together with the relevant order.

Shipping options, delivery times, and shipping costs are detailed on the Shipping and Delivery page. Delivery times are estimates in business days from dispatch and do not constitute a guaranteed delivery date. An order containing multiple items may be delivered in multiple packages.

The risk of loss and damage transfers to you the moment the carrier delivers the shipment to you or an authorized recipient at the specified address. Visible transport damage must be reported within 48 hours to [email protected], accompanied by photographic evidence. Please check your address details before completing the purchase: if delivery fails due to an incorrect address or failure to collect the parcel, the incurred shipping expenses will be deducted from the refund amount.

You may return any unused item in its original packaging within 30 days of delivery in accordance with the terms on the Returns and Refunds page. Request a return authorization number in advance and send the item exclusively to the address provided by us. The refund covers the purchase price of the item; original shipping costs are only refunded if the return is due to our error or a defect. The statutory right of withdrawal in your country of residence remains unaffected.

The goods must match the description on the product page and be free from defects upon delivery. The statutory warranty regulations of the Federal Republic of Germany apply. For new goods, the warranty period is 24 months from delivery of the item. In the event of defects in delivered electronic sound amplifiers or accessories, customers have the legal right to supplementary performance (remedying the defect or replacement delivery), provided that the goods were used as intended and excluding unauthorized tampering or improper contact with water. Any product that fails due to a defect within your country's statutory warranty period will, upon inspection, be repaired, replaced, or refunded at our discretion. Normal wear and tear, improper use, and damage occurring after delivery are excluded from the warranty.

Fraudulent orders, tampering with technical systems, scraping or extracting third-party user data, and posting unlawful, misleading, or offensive content are strictly prohibited. In the event of violations, we reserve the right to immediately block account access.

All text, imagery, graphics, logos, and software components on this website are protected by proprietary rights belonging to Novabelvarispx GmbH or the respective licensors. Accessing and printing content is permitted solely for private use. Any further reproduction, distribution, or commercial exploitation requires our written consent.

Novabelvarispx GmbH is liable without limitation in cases of intent and gross negligence, as well as for injury to life, body, or health. In the event of a slightly negligent breach of essential contractual obligations, liability is limited to typical, foreseeable contractual damages, but at most to the total value of the respective order or an amount of €100.00. We are liable without limitation for damages resulting from injury to life, body, or health, as well as for damages caused intentionally or by gross negligence, and in all other cases where liability cannot be legally limited. For other damages, our liability is limited to foreseeable damage typical for the contract.

You agree to indemnify and hold us harmless from any third-party claims arising from your breach of these terms or from content provided by you, to the extent permitted by law.

The laws of the Federal Republic of Germany apply exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer with habitual residence in another member state of the European Union, mandatory consumer protection provisions of that state remain unaffected. If a concern cannot be resolved directly, you may turn to the competent court at the seller's registered office; consumers retain the right to sue or be sued before the courts of their country of residence. Mandatory consumer protection regulations of your country of residence remain applicable.

Order confirmations, shipping notifications, invoices, and formal notices regarding these terms and conditions will be sent to the email address provided at checkout. Please keep this address up to date and check your spam folder; an email sent to this address is deemed received.

We may transfer our rights and obligations under this contract to a company that assumes business operations, provided your rights are not adversely affected. The assignment of your rights to third parties requires our written consent.

Failure by us to enforce any provision of these terms and conditions at any time does not constitute a waiver of the right to enforce it in the future.

If any part of these terms should be legally invalid, the remaining clauses remain valid. An invalid provision will be replaced by a permissible provision whose purpose comes closest to the intended economic result.

In the event of non-compliance with these terms, we reserve the right to deactivate the account or reject future orders. Shipments of goods already handed over to the carrier are excluded from this measure.

These terms, together with the relevant policies and the order confirmation, constitute the complete contractual basis for your purchase. If versions exist in different languages, the text of the language version through which the order was placed shall prevail.
